Officer Wenger responded to a request for backup for a fellow officer who had stopped a driver for speeding and determined the driver was intoxicated. After one of the passengers in the car became belligerent, got out of the vehicle and refused to get back in the car, the officers used a Taser in an attempt to subdue him. The Taser had no effect and the officers continued to struggle with the passenger. During the struggle, the passenger managed to grab a flathead screwdriver and stab Officer Wenger three times. One of the thrusts went in an area above the side panel of Wenger’s vest and made a puncture wound. The other two thrusts, both in the heart area, were stopped by his vest.
