Officer Russell had just cornered a fleeing felon in a dead-end street when the man pulled a .38 from his pocket and blasted Russell square in the chest. When Russell didn’t fall, but was instead reaching for his own weapon, the assailant turned to run but was shot by the officer. The assailant’s attorney wanted to have the assault charge lessened because Russell was wearing his (Second Chance®) vest and was not hurt. The DA and judge stood firm. “Were it not for the vest,” the DA said, “the charge would be murder.”
