Officer Givens was driving his police van along a side road at 4AM when he came across a man sitting half-on-half-off the road. The man became belligerent when asked to get off the roadway and a struggle ensued. Givens called for backup and then had his sidearm taken from his holster in the ruckus. The man pointed the .38 weapon at Givens shooting him in the stomach at close range. As the man turned to run, Givens tackled him but let loose as he tumbled down a 10-foot embankment striking his head at the bottom. His assailant was picked up later that day and IDed in a lineup.
