Deputy Wholey was on his way home when he spotted a black BMW with outstate license weaving across the centerline. He pursued the car and stopped it to investigate. The driver had already exited his BMW and was standing next to his car as Wholey approached. When the deputy was about ten-feet away, the driver pulled a .22 semi-auto from his pocket and fired five times at the deputy. Two of the five missed Wholey, the third cutting through the uniform shirt without hitting the torso at the waistline. Two other slugs struck Wholey’s concealable Second Chance® armor. Wholey returned fire once before the driver jumped back into his car and escaped. Wholey was not aware he was shot until his backup checked him out finding three holes in his uniform shirt.
