On August 9, 1973, Bingley and his partner stopped a vehicle to question the driver in reference to complaints from several young women. The subject was known to carry a gun so they approached his car with caution. The subject exited his car and started toward the police vehicle and at the same time reached under his shirt. The police officers pulled their weapons from their holsters and shouted, “Drop it.” During the gunfire exchange, Bingley was hit in the right chest area but continued to fire. Afterwards, Bingley removed his vest. He found a large red swollen mark and realized his vest had stopped the bullet. The weapon used in the assault was a .22 pistol.
